Terms and conditions for using FireGlue

Agreement to Terms

By accessing or using FireGlue ("Service," "Platform," or "FireGlue"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

FireGlue, Inc. ("Company," "we," "our," or "us") provides an email infrastructure management platform for provisioning, monitoring, and optimizing email accounts at scale.

Account Terms

Account Creation

  • You must provide accurate, complete, and current information
  • You must be at least 18 years old to use this Service
  • You are responsible for maintaining account security
  • You are responsible for all activities under your account
  • One person or legal entity may maintain no more than one free account

Account Security

  • You are responsible for safeguarding your password
  • You must notify us immediately of any unauthorized access
  • We recommend enabling two-factor authentication (2FA)
  • You must not share your account credentials

Account Types

  • Starter: 5 email accounts, 10 domains
  • Professional: 25 email accounts, 50 domains
  • Enterprise: Custom limits and features

Acceptable Use Policy

You May

  • Use FireGlue for legitimate business purposes
  • Manage email infrastructure for your organization
  • Integrate with supported email providers
  • Use our API within rate limits
  • Share access with team members

You May Not

  • Violate any laws or regulations
  • Send spam or unsolicited emails
  • Abuse, harass, or harm others
  • Distribute malware or viruses
  • Attempt to breach security measures
  • Use the Service for illegal activities
  • Resell the Service without authorization
  • Reverse engineer the platform

Email Sending Guidelines

  • Comply with CAN-SPAM Act and GDPR
  • Include unsubscribe links in marketing emails
  • Honor opt-out requests within 10 business days
  • Only send to recipients who have consented
  • Maintain clean email lists

Service Limits and Usage

Rate Limits

  • API calls: Varies by plan
  • Domain operations: Fair use policy
  • DNS queries: Reasonable usage

Storage Limits

  • Contact storage: Per plan limits
  • Log retention: 90 days
  • Backup retention: 30 days

Fair Use Policy

We reserve the right to throttle or suspend accounts that:

  • Exceed reasonable usage patterns
  • Impact service stability
  • Violate acceptable use policies

Payment Terms

Billing

  • All plans are billed monthly or annually
  • Prices are in US Dollars (USD)
  • Payment is due at the start of each billing cycle
  • We accept major credit cards

Free Trial

  • 14-day free trial for new accounts
  • No credit card required for trial
  • Full access to plan features during trial
  • Auto-converts to paid plan after trial (if card added)

Refunds

  • Monthly plans: No refunds for partial months
  • Annual plans: Pro-rated refunds within 30 days
  • Service credits may be issued for downtime
  • Refunds processed within 10 business days

Plan Changes

  • Upgrades: Effective immediately, pro-rated billing
  • Downgrades: Effective at next billing cycle
  • Changes may result in data loss if exceeding new limits

Late Payment

  • Service may be suspended for non-payment
  • $25 late fee after 10 days overdue
  • Account termination after 30 days of non-payment

Service Availability

Uptime SLA

  • Starter: Best effort (no SLA)
  • Professional: 99.9% uptime
  • Enterprise: 99.95% uptime with credits

Scheduled Maintenance

  • Announced 48 hours in advance
  • Typically during low-usage periods
  • Does not count against SLA

Service Interruptions

We are not liable for interruptions caused by:

  • Third-party services (Microsoft, Google, Cloudflare)
  • Internet connectivity issues
  • Force majeure events
  • User misconfigurations

Data and Privacy

Your Data

  • You retain ownership of all your data
  • You grant us license to process data to provide services
  • You are responsible for data accuracy
  • You must have rights to data you upload

Our Responsibilities

  • Implement reasonable security measures
  • Encrypt data in transit and at rest
  • Maintain backups for 30 days
  • Comply with applicable privacy laws

Data Export

  • You can export your data at any time
  • Standard formats: CSV, JSON
  • API access for automated exports

Data Deletion

  • Account deletion removes data within 30 days
  • Backups purged after 90 days
  • Legal holds may prevent immediate deletion

Intellectual Property

Our IP

  • FireGlue platform, code, and design are our property
  • You may not copy, modify, or distribute our IP
  • Our trademarks may not be used without permission

Your IP

  • You retain rights to your content and data
  • You grant us license to display and process your content
  • We do not claim ownership of your data

API Access

  • API is provided as-is
  • API documentation is our property
  • Client libraries are open source (where applicable)

Third-Party Services

Integrations

We integrate with:

  • Microsoft 365
  • Google Workspace
  • Zoho Mail
  • Cloudflare
  • Instantly.ai

Third-Party Terms

  • You must comply with third-party terms of service
  • We are not responsible for third-party service issues
  • Integration availability may change

API Keys

  • You must secure your API keys
  • You are responsible for API key usage
  • Revoke compromised keys immediately

Warranties and Disclaimers

Service Provided "AS IS"

  • No warranty of uninterrupted or error-free operation
  • No warranty of specific results
  • No warranty of third-party service availability

Limitation of Warranties

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including:

  • Merchantability
  • Fitness for particular purpose
  • Non-infringement

Limitation of Liability

Maximum Liability

Our total liability shall not exceed the amount paid by you in the 12 months prior to the claim.

Excluded Damages

We are not liable for:

  • Indirect or consequential damages
  • Loss of profits or revenue
  • Loss of data (beyond backup restoration)
  • Loss of business opportunity
  • Third-party claims

Exceptions

Limitations do not apply to:

  • Gross negligence or willful misconduct
  • Death or personal injury
  • Fraud or fraudulent misrepresentation

Indemnification

You agree to indemnify and hold harmless FireGlue from claims arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of third-party rights
  • Your content or data

Termination

By You

  • Cancel anytime from account settings
  • Email cancellation requests to [email protected]
  • Cancellation effective at end of billing period

By Us

We may suspend or terminate your account for:

  • Violation of these Terms
  • Non-payment
  • Illegal activities
  • Abuse of the platform
  • Risk to service stability

Effect of Termination

  • Access to the Service is revoked
  • Data export available for 30 days
  • Refunds per our refund policy
  • Outstanding fees remain due

Changes to Terms

Modification Rights

We reserve the right to modify these Terms at any time.

Notification

  • Material changes announced 30 days in advance
  • Email notification to account holders
  • Notice posted on this page

Acceptance

Continued use after changes constitutes acceptance of new terms.

General Provisions

Governing Law

These Terms are governed by the laws of the State of California, USA.

Dispute Resolution

  • Informal resolution attempted first
  • Binding arbitration in San Francisco, CA
  • Class action waiver
  • Small claims court exception

Severability

If any provision is found unenforceable, remaining provisions remain in effect.

Assignment

  • You may not assign these Terms
  • We may assign to affiliates or acquirers

No Waiver

Failure to enforce any right does not waive that right.

Entire Agreement

These Terms, Privacy Policy, and SLA constitute the entire agreement.

Support Levels

  • Starter: Email support (48-hour response)
  • Professional: Priority email support (24-hour response)
  • Enterprise: 24/7 phone and email support
